Wine is a personal period and cycle tracker operated by Nelson Ponte, Portugal. Contact [email protected] for questions, support or complaints. A postal business address is still required before these terms take effect.
These terms cover the app and website. The Privacy Policy explains personal-data processing; accepting these terms does not by itself provide consent to every use of health information. Store-specific terms may also apply to purchases.
02Who can use Wine
You must be at least 16 years old. If you are under 18, you must have any permission required by the law that applies to you to enter this agreement or make a purchase. A parent or guardian does not automatically receive access to your private records.
AI eligibility is not yet resolved for launch: the present Gemini provider terms restrict applications likely to be accessed by under-18s. The integration and eligibility controls must be changed or otherwise made compatible with Wine’s intended 16+ audience before release. Users under 18 must not use the current online AI integration; that restriction alone does not resolve the provider’s app-level requirement.
03A tracker, not medical care
Wine helps you record personal information and understand estimates and patterns. It does not provide diagnosis, treatment, medical advice or emergency monitoring. Period dates, cycle phases and fertile-window information are estimates, not confirmed biological events.
Do not use Wine as contraception, as proof that pregnancy is impossible, or as a substitute for a qualified professional. Do not change treatment based on an estimate or AI response. Seek professional advice when needed and use local emergency services for an emergency.
AI can produce inaccurate, incomplete or inappropriate responses. Review voice transcriptions and proposed logs before saving them. Demonstrations on the website are illustrative conversations, not testimonials or personalised advice.
04Your account and records
Provide information you are entitled to use, protect your sign-in method and approved devices, and contact us if you suspect unauthorised access. You are responsible for deciding what to record and share; do not upload another person’s private information without a lawful reason.
Maximum privacy recovery can make your history unrecoverable if every approved device is lost. Standard recovery works differently, as explained in the Privacy Policy. Keep any exported copies secure. You remain the owner of your content; you permit us and the relevant providers to process it only as needed to deliver the features you request and as described in the Privacy Policy.
05Using Wine fairly
Do not use Wine to harass others, distribute unlawful content, bypass access controls, misuse another person’s account or interfere with the service. Do not attempt to extract other users’ records or use the service for a purpose for which it is not designed.
Wine grants you a limited right to use the app for your personal use under these terms. Wine’s branding, software and artwork remain protected by applicable intellectual-property rights. This does not restrict rights you have under mandatory law or applicable open-source licences.
06Wine Plus and payments
Where Wine Plus is offered, the purchase screen identifies the included features, total price, billing period, renewal terms and any valid trial or promotional conditions before you pay. Features and availability may vary by platform and country. No free trial or specific price is promised by these terms.
A recurring subscription renews as disclosed at checkout unless cancelled before the relevant renewal deadline. Manage cancellation through the store or payment provider used for that purchase. Cancellation normally stops the next renewal while access continues for the paid period, subject to applicable law and the provider’s terms.
Deleting Wine or your Wine account does not cancel an App Store or Google Play subscription. Cancel it separately. Restore purchases using the same store account where supported. Refund requests can be made through the relevant store and you can also contact us about your statutory rights.
Consumers may have a statutory 14-day right of withdrawal for a distance purchase. Any exception for digital content or services applies only when its legal conditions are met, including any required express request, consent and acknowledgement. Merely using Wine or accepting these terms is not a blanket waiver. Rights relating to faulty or non-conforming digital services remain in force.
If a gift-payment feature is offered, the checkout must identify the payer’s billing responsibilities and the recipient’s access. Sharing a gift link does not share health records with the payer.
07Changes and availability
We may provide updates to maintain, secure or improve Wine. We will give appropriate notice of material changes affecting your agreement or paid access and respect applicable cancellation and refund rights. We do not promise uninterrupted availability or a particular prediction accuracy.
Access may be restricted where necessary to address abuse, security risks or legal requirements. Where appropriate, we will explain the reason and a way to contact us. We will not use this clause to avoid mandatory consumer rights or data-access obligations.
08Leaving Wine
You may stop using Wine at any time. To remove the account and associated data, use the app’s account deletion option or the website deletion request route. Export information you wish to retain before deletion. Some legal or provider records may remain as explained in the Privacy Policy.
Stopping use, uninstalling or deleting the account does not automatically cancel a subscription. Privacy requests, valid payment obligations and rights that necessarily survive termination continue to apply.
09Responsibility and your legal rights
We remain responsible to the extent required by applicable law, including applicable standards for digital services. Nothing in these terms excludes liability that cannot lawfully be excluded, or removes your rights concerning fraud, deliberate misconduct, personal injury or mandatory consumer protection.
The medical limitations above describe the intended service; they are not a waiver of rights for a defective service. Third-party services have their own conditions, but using a provider does not remove our obligations to you.
10Questions, disputes and updates
Please send concerns to [email protected] so we can try to resolve them. Portuguese law applies, without depriving consumers of mandatory protections under the law of their country of habitual residence. Competent courts and any available consumer dispute-resolution rights are determined by applicable law; these terms do not impose exclusive foreign courts or mandatory private arbitration.
The operator’s business address and any applicable Portuguese consumer dispute-resolution and complaints-book information must be completed before commercial launch. This draft does not identify a body without confirming that it applies.
Material updates will be communicated with an effective date. Where the law requires agreement or gives you a right to end the service, that right is preserved.
